Welcome to the ILG Bulletin for Direct Payment and Personal Health Budget teams.
The Supreme Court have today handed down their judgment in the Mencap case. This is significant because it provides the long-awaited clarity around the application of the National Minimum Wage (NMW) to sleep-in shifts.
We understand this judgement will impact your day-to-day work and may have significant consequences on the use of Direct Payment budgets.
The judgment needs careful consideration in light of the impact it will have across the UK, please bear with us while we produce guidance that will be useful to all organisations in the form of advice notes, podcasts and further newsletter articles.
